My Comments are Based on My Experience With The KRCE and the KRCEOA

On September 15th 1967, Pacific-Cascade Land Company, Inc. (PCLC) filed the Articles of Incorporation (Articles) for the Klamath River Country Estates Owners' Association, Inc. (KRCEOA).

On September 25th 1967, PCLC filed the By-Laws of the KRCEOA. PCLC printed a brochure of the original Articles and By-Laws of the KRCEOA to be given to new owners of land in the Klamath River Country Estates (KRCE).

This brochure was used from 1967 until 1974 when revisions were then made. When people bought land in the KRCE they were given the brochure of the KRCEOA Articles and By-Laws and a copy of the CC&Rs for Unit #1.

If, their land was in Unit #2, #3, #4 and/or #5, they would also receive a copy of the CC&Rs for whichever of those units their lot was actually located in.

The CC&Rs authorized the creation of the Architectural Control Board (ACB). The CC&Rs contained several guidelines for owners to follow as they planned the home and other structures they might want to build on their land. The plans had to be submitted to the ACB for approval.

The guidelines were broadly defined in the CC&Rs. Over the course of the first few years, the Board augmented the original guidelines with other criteria for home design.

In 1974, the Board made some minor and some major revisions of the Articles, By-Laws, CC&Rs and the ACB guidelines. The Board rewrote, edited, corrected and finally got a vote of approval from the Owners for the rewritten documents.

Sometime around March or April of 1974, the Board, under then-President Albert Winslow, printed the first Owners' Manual for the KRCEOA which combined the Articles, By-Laws, CC&Rs (for Unit #1 ONLY) and the ACB guidelines, plus some policies regarding the use of the KRCEOA pool, lodge and campground.

The 1974 Owners Manual seemed to be resolve most complaints and confusion. But, some unrecognized problems were caused by the 1974 Owners Manual. Those problems were not corrected by the 1980 revisions to the Owners Manual. A 2005 attempt to 'make it all right' (my assumption) exacerbated the errors of 1974 and 1980.

We bought our lot in 2010. Our Realtor gave us an electronic file of the 2005 version of the Owners' Manual. The Mt. Shasta Title Company office in Yreka gave us a printed copy of the 1967/1968 recorded copies of the CC&Rs for Unit #1 and #2, and of the "All-In-One" CC&Rs that were recorded in 2003 (twice), 2005 and 2009. After we closed the sale, we received a printed copy of the "then-current" Owners' Manual from the secretary at the KRCEOA office when I turned in a copy of our deed and transfer information for the KRCEOA office files.

In the following sections of this page I have placed links to scanned copies of the complete Owners' Manuals for 1967-1974, 1974-1979, 1980-2005, 2005-2010 and June 16th 2014.

I broke the large PDF files into smaller separate files of the: Articles of Incorporation, the By-Laws (including Board policies) and the Architectural Control Board from each Owners' Manual. The small files make it easier to compare differences between the revisions. I used color highlighting to mark the key dofferences.


 
 

1967-1974: Owner Handbook

The first handbook contained the Articles of Incorporation and the By-Laws for the KRCEOA. Buyers/Owners were given a separate copy of the Unit #1 CC&Rs as recorded in the Siskiyou County Recorder's Office in Yreka California. When lots were sold in Units #2, #3, #4 and #5, those buyers/owners received the Handbook along with copies of the CC&Rs for Unit #1 and the Unit their lot was located in.

The fourth Owners' Manual contained the 2009 versions of the Articles of Incorporation and the By-Laws for the KRCEOA, the 2009 version of the CC&Rs for Unit #1, and the 2009 versions the ACB Guidelines and the 2014 versions of Board policies for use of the campground facilities, hunting, and lot camping and development. Buyers/Owners should have been given a separate copy of the CC&Rs for lots that they bought in Units #2, #3, #4 and/or #5.
